When a mailbox post is actually hit by a Town Highway plow, we will replace the mailbox with a standard mailbox and a standard post when necessary. We are not obligated to replace custom-built, ornamental or plastic mailboxes. When the weight of snow is what causes damage to a mailbox or post, it is the homeowner’s responsibility to replace the mailbox and/or post. Please call the Town Highway Department at 716-941-3552 if you feel that a town plow has damaged your mailbox and it will be checked out as soon as possible.
Under Section 1219 Subdivision A of The New York State Vehicle and Traffic Law: “No person shall throw or deposit upon any highway, snow or other substances likely to injure any person, animal or vehicle”. Any prosecutors of this law will be prosecuted. So, when plowing snow out of your driveway, be sure to completely clean up any snow in the road.
